Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of the Binayah mobile application and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Binayah helps private residential communities in Jordan communicate, manage operations (such as announcements, maintenance, visitors, and guard tools where enabled), and track shared finances. Communities are private by default; access requires invitation or approval. A separate craftsmen directory may allow residents to discover local service providers; contact is handled in-app without exposing phone numbers.
2. Eligibility
You must be at least 18 years old (or the age of majority in Jordan) and able to form a binding contract. You are responsible for the accuracy of information you provide and for keeping your login credentials secure.
3. Accounts
- You may sign up with email and/or phone verification as offered in the app.
- You are responsible for all activity under your account.
- Notify us promptly at support@binayah.app if you suspect unauthorized access.
- We may suspend or terminate accounts that violate these Terms or pose a security risk.
4. Property membership and roles
Access to a property’s data requires an active membership assigned by a manager or through an approved join flow. Roles (e.g. resident, manager, guard) determine what you can view and do. Managers are responsible for inviting members appropriately and for content posted on behalf of the building. We are not a party to disputes between residents, managers, or owners.
5. Subscriptions and billing
Residents use the app free. Building committees or authorized managers may purchase a per-property Full subscription for advanced features such as finance tools and guard modules. Property owners may also purchase creator capacity to own additional active properties. Subscription fees, trials, and payment via CliQ or other methods offered in the app are described at purchase time. Fees are in Jordanian Dinars (JOD) unless stated otherwise. Subscriptions renew according to the plan selected until cancelled by the paying party. We may change pricing for new subscriptions with notice; existing paid periods are honored as described in the app.
The app records expenses and savings fund activity; it does not move money between users. Payments between residents and the building happen outside the app (e.g. cash or CliQ).
6. Acceptable use
You agree not to:
- Use the Service for unlawful, harassing, defamatory, or fraudulent purposes.
- Attempt to access property data without membership or bypass security controls.
- Scrape, reverse engineer, or overload our systems except as permitted by law.
- Share invite codes publicly in a way that compromises building security.
- Impersonate others or misrepresent your affiliation with a property.
- Upload malware or content that infringes others’ rights.
7. User content
You retain ownership of content you submit. You grant us a limited license to host, display, and process that content solely to operate the Service for your property. Managers and members with appropriate roles may see content you post within the same property. You are responsible for your content and must have rights to share it.
8. Craftsmen marketplace
Listings and reviews are provided by users and craftsmen. We do not guarantee quality, availability, or outcomes of any job. Craftsmen contact residents through in-app relay; we are not responsible for work performed off-platform. Featured or verified badges reflect app criteria only, not professional licensing unless explicitly stated.
9. Privacy
Our Privacy Policy explains how we collect and use personal information, including our commitment to keep phone numbers private. The Privacy Policy is incorporated into these Terms by reference.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION. GUARD AND SAFETY FEATURES ARE TOOLS TO ASSIST YOUR BUILDING; THEY ARE NOT A SUBSTITUTE FOR EMERGENCY SERVICES. CALL LOCAL EMERGENCY NUMBERS WHEN IN DANGER.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BINAYAH AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) TEN JORDANIAN DINARS (JOD 10), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or if required for security or legal compliance. Provisions that by nature should survive (including disclaimers, liability limits, and governing law) will survive termination.
13. Governing law
These Terms are governed by the laws of the Hashemite Kingdom of Jordan, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of the competent courts in Amman, Jordan, unless mandatory consumer protection rules provide otherwise.
14. Changes
We may modify these Terms by posting an updated version on this page. Material changes will be indicated by updating the “Last updated” date. Continued use after changes constitutes acceptance. If you disagree, discontinue use and delete your account.
